All production related mining and mill operations have been terminated <br /> from October 23, 1985. <br /> 2. This letter will be mailed within one (1) day after receipt of the <br /> Notice. <br /> 3. The Technical Revision Stipulations that are available at this time are <br /> enclosed with this letter. <br /> 4. The Twelve Thousand Two Hundred Dollars ($12,200.00) civil penalty <br /> will be paid within 30 days of November 8, 1985. <br /> Technical Revision Stipulations <br /> 1. Updated draft copies of the mine water treatment sludge analysis for <br /> the American Tunnel-and Terry Tunnel sites are enclosed in the letter. <br /> Upon completion of the arsenic parameter, the MLRD will receive the <br /> final analysis and laboratory analysis procedure information. <br /> 2. The permeability tests and textural classification results for Tailings <br /> Pond No. 3 are enclosed in this letter. A sampling location map will be <br /> submitted to the MLRD by November 15 , 1985. <br /> 3. The flood control berm was completed on October 25, 1985. Before and <br /> after photos are enclosed with this letter. <br /> 4. Two (2) down gradient ground water monitoring wells have been constructed <br /> below the Engineer Office sludge disposal area as of November 7, 1985. <br /> Photographs of the wells, together with a location map and cross section <br /> will be submitted to the MLRD prior to December 22, 1985. <br /> 5. Certifications by a qualified professional engineer for the above mentioned <br /> flood control berm, Tailing Pond No. 3 and ground water monitoring wells <br /> will be submitted prior to December 22, 1985. <br /> 6. Groundwater sampling of the above mentioned wells will be on a quarterly <br /> basis for at least one (1) year. Upon completion of the mine water <br /> sludge analysis, parameters will be mutually agreed upon by the MLRD and <br /> the operator. Samples will be taken in accordance with EPA protocol <br /> and analyzed by an EPA certified laboratory. <br />
