CO-0036056 <br /> San Juan County, Colorado <br /> ------------------------------------------------------------------------------- <br /> TO: Suunside Cold Corporation <br /> F fNDTNCS OF FACT <br /> Pursuant to the authority vested in the Division of Administration of the <br /> Colorado department of Health ("the division" ) by 25-8-301. to 308, C. R .S . <br /> (1982 and 1985 supp. ) , which authority has been delegated to me by the <br /> executive director of the department, I hereby make the following findings of <br /> fact : <br /> 1. Sunnyside Cold Corporation ("Sunnyside Cold" ) operates an <br /> underground hardrock mine ( "the mine" ) approximately 2 1/2 miles north <br /> northwest of Silvercon, Colorado. <br /> 2. The mine is accessed during certain portions of the year via an <br /> adit called the Terry Tunnel. <br /> 3. Water draining from the Terry Tunnel receives chemical treatment <br /> and flows through two settling ponds prior to discharging to the North Fork of <br /> Eureka Gulch, a tributary to the Animas River. <br /> 4. Sunnyside Cold holds Colorado Discharge Permit System permit <br /> No. CO-0036056, ("the permit" ) authorizing the discharge described in <br /> paragraph 3 above. The permit became effective on October 21, 1982, is <br /> scheduled to expire on September 30, 1986, and has been administratively <br /> extended beyond September 30, 1986 until such time that a new permit becomes <br /> effective. <br />
