7. The Division agrees to petition the Department's Executive Director <br /> or his designee to impose a total civil penalty of $20,000 for the January <br /> Notice and Order and the February Notice and Order, of which $10,000 will be <br /> suspended subject to Sunnyside meeting the following conditions : <br /> - the treatment ponds at the American Tunnel shall be cleaned at a <br /> minimum, twice in 1987. In 1988, the ponds shall be cleaned at least <br /> two times, <br /> - the treatment ponds at the Terry Tunnel shall be cleaned, at a <br /> minimum, twice in 1987 and twice in 1988; <br /> - the reagent optimization program for the American Tunnel shall be <br /> implemented no later than October 15, 1987; <br /> - Sunnyside shall submit a Treatment Systems 0 erations Plan for both / <br /> the American and Terry Tunnel permit sites by }��-3g 1987; the <br /> Plan shall be implemented by October 31, 1987. Sunnyside shall <br /> submit written notice to that effect. I <br /> 8. Sunnyside agrees to monitor pH levels twice weekly at the American <br /> Tunnel at the following locations : 1) the influent to pond #1; 2) the <br /> effluent to the creek; and 3) the ditch prior to chemical addition. Results <br /> will be summarized and reported as an attachment to each Discharge Monitoring <br /> Report . At the request of Sunnyside, the Division may agree to a reduction in <br /> the sampling frequency at some point prior to the expiration of this Agreement. <br /> 9. Sunnyside agrees to meet the following interim limits for final <br /> discharge from the American Tunnel (permit CO-0027529) through <br /> October 30, 1988: <br /> 30-day average Daily Maximum <br /> Total Suspended Solids, (TSS) mg/1 45 75 <br /> Total Zinc, mg/1 9.4 12.4 <br /> 10. Sunnyside and the Division agree that this Agreement and Stipulated <br /> Order applies to the recently issued renewal permits for the Terry Tunnel <br /> (issued June 15, 1987) and the American Tunnel (issued OJ10 bc- J , 1987) . <br /> 11. The final limits at the American Tunnel for total zinc and TSS become <br /> effective on October 31, 1988. Consistent with the permit, the total zinc <br /> final limits are 0.75 mg/1 (30-day average) and 1.5 mg/1 (daily maximum); the <br /> final TSS limits are 20 mg/l (30-day average) and 30 mg/1 (daily maximum) . <br /> 12 . Sunnyside agrees that this Agreement and Stipulated Order has the <br /> same effect and force as a final Cease and Desist Order issued pursuant to <br /> 25-8-605, C.R.S. (1982) . Sunnyside further agrees that any violation of this <br /> Agreement and Stipulated Order is subject to action under 25-8-605 to <br /> 25-8-608, C.R.S. (1982) . <br /> -2- <br />
