This conclusion is based more <br /> on the provisions of the permit than any other factor, as we <br /> are aware that changes of this nature should be reviewed and <br /> approved by the technical revision process. <br /> While we admit that disposal of the sludge on-site was not a <br /> provision of the permit, we maintain that the sludge was <br /> safely contained in the pits and an open discussion of the <br /> matter was maintained with the Division. We believe that no <br /> environmental damage resulted and therefore with our <br /> commitment to move the sludge to the location designated in <br /> the permit, no penalty should be requested at the August <br /> 24-25, 1988 Board meeting. <br /> Excavation and transport of the sludge to Pond No. 3 is <br /> scheduled to start August 29 , 1988. The sludge will be <br /> excavated by an excavator and transported by 10 wheel dump <br /> trucks . Initial estimates of volume and productivity <br /> results in a time requirement of 21 working days to complete <br /> the transfer. The Division will be notified upon completion <br /> of the project. <br />
