File No. M-77 73 8 <br /> Dear Mr. Pe ri no: <br /> On October 28, 1987 we conducted an inspection of your mine and found that <br /> pond sediments from the Terry Tunnel water treatment settling ponds were <br /> placed in an excavated trench rather than' disposed of atop Pond No. 3 as <br /> required in the permit. <br /> We believe this is in violation of C.R.S. 34-32-124, for failure to comply <br /> with the conditions of an order, permit, or regulation and the following <br /> provisions under C.R.S. 34-32-116: <br /> d. Acid-forming or toxin-producing material that has been mined shall <br /> be handled in a manner that'will protect the drainage system from <br /> pollution. <br /> f. In those areas where revegetation is part of the reclamation plan, <br /> land shall be revegetated in such a way as to establish a diverse, <br /> effective, and long-lasting vegetative cover that is capable of <br /> self-regeneration and at least equal in extent of cover to the <br /> natural vegetation of the surrounding area: Native species should <br /> receive first consideration, but introduced species may be used in <br /> the revegetati on process when found desirable by the board. <br /> h. Disturbances to the prevailing hydrologic balance of the affected <br /> land and of the surrounding area and to the quality and quantity of <br /> water in surface and ground water systems both during and after the <br /> mining operation and during reclamation shall be minimized. <br /> j. All surface areas of the affected land, including spoil piles, <br /> shall be stabilized and protected so as to effectively control <br /> erosion and attendant air and water pollution. <br /> We have conducted the additional analysis as referenced in my letter dated <br /> May 9, 1988. A memorandum has been enclosed which presents the results of <br /> this analysis.
