Hickenlooper <br />Governor <br />Mike King <br />Executive Director <br />Loretta Pineda <br />Director <br />The Division of Reclamation, Mining and Safety (Division) has reviewed the content of the City of <br />Greeley 112c permit amendment application adequacy response dated August 10, 2012 for the 25 <br />Avenue Site (Poudre Ponds), File No. M- 2002 -020, and submits the following comments. The <br />Division is required to make an approval or denial decision no later than August 20, 2012 therefore; <br />a response to the following adequacy review concerns should be submitted to the Division as soon <br />as possible. <br />1. The Applicant submitted proof of notice to the following mineral rights owners, The Estate of <br />H.L. Willett and Wellstar Corporation. These mineral rights owners are not listed on the Exhibit <br />C maps or in Exhibit 0. Please explain why these mineral rights owners were noticed and revise <br />Exhibits C and 0 accordingly. <br />2. The Applicant submitted proof of notice to the following easement owner, "Assoc. Natural Gas <br />Inc "; however the easement owner name is listed as "Natural Gas Assoc." on the Exhibit C <br />maps. Based on the Division's research "Associated Natural Gas, Inc." and "Natural Gas <br />Associates, Inc." are both registered to Duke Energy Natural Gas Corporation. Please confirm <br />the proper easement owner was noticed by the Applicant and revise the application exhibits <br />accordingly. <br />3. In response to Item #12, the Applicant stated a minimum width of 50 feet is needed between <br />any constraining feature (i.e. permit boundary) and the final reservoir top of bank to allow <br />room for installation of the slurry wall. The process to increase the crest width to the required <br />50 foot width is depicted in a cross - section on the revised Exhibit C -5 map. The cross - section <br />indicates a minimum crest width of 80 feet instead of the described 50 feet.
