Our <br />review indicates the NOI application contains deficiencies as defined by Rule 5.1.3 of the Mineral Rules <br />and Regulations of the Colorado Mined Land Reclamation Board for Hard Rock, Metal, and Designated <br />Mining Operations. The Division requires the information described below before we can approve the <br />NOI application. <br />1. On August 2, 2012, the Applicant corresponded with the Division via email. In the correspondence, <br />the Applicant indicated that no production mining would occur under the NOI as was initially <br />proposed in the original submittal. Therefore, it is the Applicant's responsibility to provide the <br />Division with an updated NOI form which reflects the revised project description. Upon receipt of the <br />revised NOI form, the Division will move forward with the adequacy review. <br />2. On Page 3 of the NOI Application under Section III — Project Description, the Applicant did not <br />include a project completion date. Please include this information on the revised NOI Application. <br />Be advised that if these items have not been addressed within 60 days of the date of this letter (October <br />15, 2012), the Division may terminate the NOI application in accordance with Rule 5.1.3(c) of the Hard <br />Rock Rules. <br />If you have any questions, you may contact me at (303)866 -3567 x8116. <br />Sincerely, <br />Michael A.
