Remarks:
Signed:
DATE: July 26, 2011
BLUE EARTH 40
TO: ATMOS Energy
1200 11 Avenue
Greeley, Colorado 80631
FROM: Bill Schenderlein
Blue Earth
P.O. Box 973
Fort Collins, Colorado 80522
(970) 227 -2803
WE TRANSMIT: THE FOLLOWING: FOR YOUR:
IN Attached
II Originals ❑ Use
❑ Information Below ❑ Copy of Lette ❑ Approval
❑ Applications ❑ Information
❑ Specifications . Review & Comment
❑ Other
The City of Greeley is in the process of obtaining a Colorado Division of Reclamation, Mining and
Safety (DRMS) permit for the mining and reclamation of historic Lafarge West mining pits in Weld
County (see Vicinity Map). The mining will include deepening existing pits and reclamation will
involve slurry wall construction to create a below -grade water storage reservoir.
As part of the DRMS permitting, the City of Greeley has identified permanent man -made structures
owned by ATMOS Energy within or adjacent to the project (see Pre - Mining/Mining Plan Map). To
protect your interests in the structure, the City of Greeley is offering an agreement that provides
ATMOS Energy compensation for structure damage. A typical agreement is attached.
Since mining on the project site will progress at 3H:1V slopes and slurry wall construction is not known
to affect the stability of adjacent structures, the City of Greeley does not anticipate any structure
damage. However, to ensure your interests are protected, we request that you please consider the
Structure Agreement enclosed.
If a representative of your organization will please sign and return the agreement to us, the City of
Greeley will in -turn sign the agreement and we will return a copy of the completed agreement to you for
your records. Please call me at (970) 227 -2803 with any questions or to schedule a meeting for
agreement revisions.
William Schenderlein
LETTER OF TRANSMITTAL
