Pineda <br />Director <br />12250 State Highway 12 <br />Weston, CO 81091 <br />Re: New Elk Coal Mine, C1981 -012, Second Quarter 2012 Discharge Monitoring Report Review <br />Dear Mr. Thompson: <br />On July 30, 2012, New Elk Coal Company (NECC) submitted Second Quarter 2012 Discharge Monitoring reports <br />for CDPHE Permit No. CO- 0000906. The inspections were conducted between April 1, 2012 and June 20, 2012. <br />In accordance with Rule 4.05.13(2)(111)(A) NECC submitted a copy of the Discharge Monitoring Reports to the <br />Division within 30 days following the close of the quarter. <br />NECC identified discharge at Pond 1 and Pond 7. None of the reported parameters exceeded the effluent <br />limitations. Monitoring wells were samples and sample results were reported. <br />The Second Quarter 2011 DMR reports are in compliance with the requirements of 4.05. 1 The report <br />forms for the monitoring well have a note written on the report that states, " Refer to attachment to cover letter." <br />The Division dod not receive an attachment that provides any explanation to these submitted reports.
