BASIN 8 MD <br />UTM COORDINATES (Meters,Zone:13,NAD83) <br />Easting: 573806 Northing: 4517767 <br />CONDITIONS OF APPROVAL <br />1 ) This well shall be used in such a way as to cause no material injury to existing water rights. The issuance of this permit <br />does not ensure that no Injury will occur to another vested water right or preclude another owner of a vested water right from <br />seeking relief in a civil court action. <br />The construction of this well shall be in compliance with the Water Well Construction Rules 2 CCR 402 -2, unless approval <br />of a variance has been granted by the State Board of Examiners of Water Well Construction and Pump Installation <br />Contractors in accordance with Rule 18. <br />3) Approved for use of an existing well (cancelled permit no. 284580) pursuant to CRS 37790-107 and the Findings of the <br />Groundwater Commission dated March 15, 2011. <br />4) The pumping rate of this well shall not exceed 250 GPM. <br />5) The annual withdrawal of ground water from this well shall not exceed 400 acre -feet. The total combined volume of <br />withdrawals by this well and all other wells withdrawing from the Laramie -Fox Hills aquifer beneath the 3840 acres of <br />overlying land, as described in the Findings referenced above, shall not exceed 112,000 acre -feet. <br />The use of water under this permit is limited to irrigation, industrial and commercial, livestock, fish rearing, recreation, and <br />pond filling on the 3840 acres of overlying land, as described in the Findings referenced above; and additionally in all of <br />Weld County for industrial and commercial use via truck hauling. <br />7) This well must be constructed to withdraw water from only the Laramie -Fox Hills aquifer. The top of the Laramie -Fox Hills <br />aquifer is located approximately 420 feet below the ground surface. The bottom of the Laramie -Fox Hills aquifer is located <br />approximately 800 feet below the ground surface. Plain casing must be installed and grouted to prevent the diversion of <br />water from other aquifers and the movement of water between aquifers. <br />The owner shall mark the well in a conspicuous place with well permit number(s), name of the aquifer, and court case <br />number(s) as appropriate. The owner shall take necessary means and precautions to preserve these markings. <br />A totalizing flow meter or Commission approved measuring device must be installed on this well and maintained in good <br />working order. Permanent records of all diversions must be maintained by the well owner (collected at least annually) and <br />submitted to the Ground Water Commission upon request. <br />10) This well shall be constructed within 200 feet of the location specified on this permit. <br />11) The use of water from the well under this permit must have occurred, and a completed Statement of Beneficial Use <br />(including the pumping rate and annual appropriation) must be filed by the well owner, within three years of the date of <br />issuance of this permit. <br />State Engineer <br />ged-g/d4741 I <br />DATE ISSUED 03 -15 -2011 B EXPIRATION DATE - .03 -15 <br />
