(P Northing: 45177(0 -7 <br />CONDITIONS OF APPROVAL <br />1) This well shall be used in such a way as to cause no material injury to existing water rights. The issuance of this permit <br />does not ensure that no injury will occur to another vested water right or preclude another owner of a vested water right from <br />seeking relief in a civil court action. <br />2) The construction of this well shall be in compliance with the Water Well Construction Rules 2 CCR 402 -2, unless approval <br />of a variance has been granted by the State Board of Examiners of Water Well Construction and Pump Installation <br />Contractors in accordance with Rule 18. <br />3) Approved pursuant to CRS 37 -90 -107 and the Findings of the Groundwater Commission dated March 15, 2011. <br />4) The pumping rate of this well shall not exceed 200 GPM. <br />5) The annual withdrawal of ground water from this well shall not exceed 320 acre -feet. The total combined volume of <br />withdrawals by this well and all other wells withdrawing from the Upper Laramie aquifer beneath the 3840 acres of overlying <br />land, as described in the Findings referenced above, shall not exceed 57,600 acre -feet. <br />6) The use of water under this permit is limited to irrigation, industrial and commercial, livestock, fish rearing, recreation, and <br />pond filling on the 3840 acres of overlying land, as described in the Findings referenced above; and additionally in all of <br />Weld County for industrial and commercial use via truck hauling. <br />7) This well must be constructed to withdraw water from only the Upper Laramie aquifer. The top of the Upper Laramie <br />aquifer is located approximately 150 feet below the ground surface. The bottom of the Upper Laramie aquifer is located <br />approximately 425 feet below the ground surface. Plain casing must be installed and grouted to prevent the diversion of <br />water from other aquifers and the movement of water between aquifers. <br />8) The owner shall mark the well in a conspicuous place with well permit number(s), name of the aquifer, and court case <br />number(s) as appropriate. The owner shall take necessary means and precautions to preserve these markings. <br />9) A totalizing flow meter or Commission approved measuring device must be installed on this well and maintained in good <br />working order.
