( "Holcim "). Within Holcim, I am responsible for the Boettcher Limestone Quarry site <br />and am responding to your letter to the Division or Reclamtion, Mining and Safety, regarding the <br />Response to Reclamation Permit Partial Acreage Release Request Consideration. <br />On May 18, 2010 there was a site inspection conducted by Water Commissioner George Varra <br />and Gordon Benton representing Holcim. Subsequent to that inspection, Mr. Benton received a <br />letter from Mr. David Nettles regarding the inspection and outlining four options to address the <br />ponding issue. On September 30, 2010, I responded (copy of letter attached) to the letter <br />indicating that it was Holcim's intent to pursue Option A — "Demonstrate to our satisfaction that Pit <br />2 does not expose groundwater" as it was Holcim's belief that the water in Pit 2 was from <br />precipitation and not ground water and that additional time was needed to investigate this option. <br />Since then, Holcim has been unsuccessful in trying to show that the water in Pit 2 is not ground <br />water and at this time is following up to to inform you that Holcim will file for a water well permit <br />and either a State Engineer approved Substitute Water Supply Plan or a Water Court approved <br />Augmentation Plan. To accomplish this, Holcim has solicited a proposal from Golder and <br />Associates ( "Golder") to complete this work and file the plans and permit. Upon receipt of the <br />proposal from Golder, Holcim will move forward as indicated above. <br />Also, in a recent inspection of the property we observed that we have another area where water <br />appears to have accumulated and would like to schedule another site visit with the State <br />Engineers Office to review the site to determine whether further action is required. <br />
