BLM has reviewed <br />this proposed modification to existing exploration operations and per 43 CFR 3809, responded <br />accordingly via email within the regulatory required timeframe of 15 days. <br />Based on the review of data that is currently available, there does not appear to be a direct conflict with <br />archeological sites or threatened and/or endangered species and their habitat within the proposed <br />extended project boundary. Although not currently identified, continued awareness during project <br />implementation is critical so cultural resources are not inadvertently disturbed or destroyed. <br />Regulations outlined in 43 CFR 3809.420 provide further details on performance standards that <br />continue to apply to your modified notice operation, which include those related to cultural resources <br />and threatened or endangered species. <br />BLM will coordinate with the Colorado Division of Reclamation, Mining and Safety (CDRMS) <br />regarding a review of the existing financial guarantee, which may result in an increase based on the <br />increased surface disturbance.
