Standard Metals <br />Technical Revision Sunshine #16 <br />STIPULATIONS <br />1) The Operator must submit sample analyses of mine water treatment <br />sludge from American Tunnel and the Terry Tunnel. Samples shall be <br />taken in accordance with EPA protocal and shall be sent to an EPA <br />certified lab. Results shall be submitted to the Division prior to <br />December 22,1985. <br />2) The Operator must submit results of permeability tests of tailings <br />slimes at the Tailings No.3 Pond. These results must be submitted to <br />and reviewed by the Division prior to the disposal of mine water <br />treatment sludge at this location. <br />3) Construction of the berm along the meander above the sludge, which <br />was disposed along the banks of the Animas River, must be completed <br />prior to December 1, 1985. <br />4) At least two (2) down gradient ground water monitoring wells must be <br />constructed below the sludge area along the banks of the Animas River <br />prior to December 1, 1985. <br />5) Construction of the above berm, placement of the tailings slime <br />liner in pond No. 3 and construction of the ground water monitoring <br />wells must be inspected and certified by a qualified professional or a <br />registered professional engineer. Certifications must be submitted to <br />the Division prior to December 22,1985. <br />6) Ground water sampling of the above wells shall be on a quarterly <br />basis for at least one full year to determine possible effects of in <br />place reclamation of the sludge along the banks of the Animas River. <br />Parameters shall be mutually agreed upon by the Division and the <br />Operator. Samples shall be taken in accordance with EPA protocol and <br />analysed by an EPA certified lab. Results shall be submitted quarterly <br />to the Division. <br />Once Stipulations No. 1 through No. 5 have been complied with, the Cease and <br />Desist Order shall be lifted. <br />Note: For the Record, this revision calls for submitting of a complete Permit <br />Amendment on or before April 29, 1986. <br />4353 � /T ;p116,f9C0p 10/23/851 etta <br />7 Tk <br />
