Sandra Brown <br />August 8, 2012 <br />Page 2 <br />for many years I think it would be reasonable to approve the temporary suspension of baseline data <br />collection. If CAM obtains a coal sales contract for the McClane Canyon Mine under their current <br />permit term or if they obtain approval for expansion of the mine plan and surface facilities <br />(proposed PR -02 application) then it would be appropriate to recommence monitoring at the <br />loadout if in fact they intend to utilize the loadout. My recommendation is that through a technical <br />revision we approve a temporary suspension of water monitoring at the Fruita Loadout until such <br />time that CAM informs us that they intend to construct the loadout. <br />Please let me know if you concur or if you require additional information. <br />Enclosure <br />C: Denver Project File <br />
