Pineda <br />Director <br />New Elk Coal Company (NECC) notified the Division on August 7, 2012 that the New Elk Mine <br />has temporarily suspended operations. Press releases for NECC indicate that operations were <br />suspended on July 11, 2012. At that time, NECC believed that the temporary suspension of <br />operations would last for approximately 60 days. The Division confirms that the mine is in <br />Temporary Cessation status. <br />Should the temporary cessation of operations exceed 90 days, please assure that the information <br />required by Rule 4.30.1(2) is submitted to the Division. <br />Please assure that all information required by Rule 4.30.1(3) is contained on the mine <br />identification sign by August 10, 2012 (30 days following the start of the suspension of <br />operations). <br />Sincerely, <br />(r <br />Janet H.
