PRIOR TO THE INSTALLATION OF THE MONUMENT NETWORK BENCHMARKS, <br /> THE OPERATOR SHALL OBTAIN APPROVAL FROM THE DIVISION OF THE BENCHMARK'S <br /> LOCATION AND CONSTRUCTION. FOLLOWING RECEIPT OF THAT APPROVAL, THE <br /> OPERATOR SHALL AMEND MAP 28B TO INDICATE THE LOCATION OF THE APPROVED <br /> BENCHMARKS. <br /> In order to avoid unfortunate inadequacies in future subsidence monitoring <br /> program reports to the Division, the Division believes it appropriate to <br /> develop an acceptable report format. Therefore, the Division has imposed <br /> the following stipulation: <br /> THE DIVISION DIRECTS COLORADO WESTMORELAND, INC. TO SUBMIT REPORTS OF <br /> ITS SUBSIDENCE MONITORING PROGRAM ON A SEMI-ANNUAL BASIS, COMMENCING <br /> ONE MONTH AFTER THE INSTALLATION AND INITIAL SURVEYING OF THE SUBSIDENCE <br /> MONUMENTS. FURTHER, DUE TO THE COMPLEXITY OF THE PERMIT AREA GEOLOGY, <br /> PRESENCE OF STEEP SLOPES, AND SENSITIVE HYDROLOGIC ELEMENTS, COLORADO <br /> WESTMORELAND, INC. IS DIRECTED TO SUBMIT A PROPOSED SUBSIDENCE MONI- <br /> TORING REPORT FORMAT TO THE DIVISION FOR APPROVAL. THIS REPORT FORMAT <br /> SHOULD RECOGNIZE THE IMPORTANCE OF CONTINUAL UPDATE OF SUBSIDENCE DATA <br /> INTERPRETATION, MONITORING OF GROUNDWATER LEVELS AND SPRING FLOWS, <br /> MONITORING OF MINE INFLOW, AND SUBSURFACE GROUND CONDITIONS WHICH COULD <br /> BE CORRELATED TO SUBSIDENCE PREDICTION. THIS REPORT FORMAT SHALL BE <br /> APPROVED BY THE DIVISION PRIOR TO THE COMMENCEMENT OF EXTRACTION OF <br /> COAL WITHIN THE 5 NORTH PANEL OFF THE 8TH EAST MAIN OF THE ORCHARD VALLEY <br /> MINE. <br /> i <br /> XXIV. SPECIAL CATEGORIES OF MINING OTHER THAN A VF AND PRIME FARMLAND (2.06, <br /> 4.22, 4.23, 4.26, 4.27, 4.28, 4.29) <br /> Orchard Valley mine has requested a variance from the requirement for restor- <br /> ation of affected lands to their approximate original contour in a portion of <br /> the proposed permit area. Necessary information has been supplied demonstra- <br /> ting compliance with 2.06.5 and 4.27.4. Information demonstrating compliance <br /> can be found in Volume 10, Stability Analysis, Volume 8A, Section 2.05 and <br /> 2.06, and the stipulations contained in Section XVII, Backfilling and Grading. <br /> The coal loadout facility is located within the proposed permit area. There <br /> will be no in situ coal processing operations at the site. <br /> Since this is an underground mine, provisions pertaining to mountaintop <br /> revival, steep slope mining and augerin g operations are not applicable. There <br /> are no surface mining activities adjacent to the proposed permit area. <br /> The proposed operation is in compliance. Information demonstrating compliance <br /> can be found in Volume 8A, Section 2.06 of the permit application. <br /> l - <br />
