MINE FACILITIES, COAL HANDLING STRUCTURES, SUPPORT FACILITIES <br /> (2.05.3(7) , 4.04) <br /> All coal handling structures and support facilities are located within the <br /> proposed permit area. All facilities and coal handling structures meet the <br /> requirements of the regulations. <br /> The proposed operation is in compliance. <br /> Additional information demonstrating compliance can be found in Volume 8A, <br /> Section 2.05 of the permit application. <br /> XX. ROADS (2.05.3(3) , 4.03) <br /> The Orchard Valley mine road system consists of one paved haul road leading from <br /> security post #1 at the turn-off from the Stevens Gulch road to the crushing <br /> and screening bench; an access road leading from the crushing and screening <br /> bench up to the warehouse area, portal bench and fan bench, and two lower <br /> access roads which lead to the existing waste disposal pile and sedimentation <br /> ponds 1-4. <br /> Information on these roads can be found in Section 4.03 of Volume 8B, <br /> pages 37-40, Section 2.05 of Volume 8A, and Map No. 13 in volume 5. These <br /> sections of the 'permit application have been reviewed by the Division , and <br /> with the acceptance by Colorado Westmoreland, Inc. of the stipulation below, <br /> the proposed operation is in compliance. <br /> The mine site haul road and access roads were constructed prior to the enactment <br /> of SCMRA and the Regulations of the Colorado Mined Land Reclamation Board for <br /> Coal Mining, and at that time the haul and access road embankments and road <br /> cuts were not constructed according to the specifications set forth in Rule <br /> 4.03. Alternative specifications may be authorized by the Division if the <br /> applicant can demonstrate .through appropriate geotechnical analysis that the <br /> existing road embankments have a minimum safety factor of 1.25, and that the <br /> road cuts have a minimum safety factor of 1.5 or that a lessor safety factor <br /> will not result in significant enrieonmental harm or harm to the public <br /> health or safety (4.03.1(3) (c) (i) and (3) (c) (x),, and 4.03.2(3) (c) (i) and <br /> (3) (c) (ix)) . Currently, the applicant is preparing these demonstrations as <br /> part of an overall stability analysis study for the mine bench area being <br /> conducted under the direction of Merrick & Company, but the completed study <br /> and road stability demonstrations have not yet been submitted to the Division. <br /> THE APPLICANT MUST PROVIDE TO THE DIVISION, AS PART OF PHASE II OF THE <br /> STABILITY ANALYSIS STUDY BEING CONDUCTED UNDER THE DIRECTION OF MERRICK <br /> & COMPANY, A DEMONSTRATION THAT THE EXISTING HAUL AND ACCESS ROAD EMBANK- <br /> MENTS HAVE ACHIEVED A MINIMUM SAFETY FACTOR OF 1.25, AND THAT THE <br /> EXISTING HAUL AND ACCESS ROAD CUTS HAVE ACHIEVED A MINIMUM SAFETY FACTOR <br /> OF 1.50 OR THAT A LESSER SAFETY FACTOR WILL NOT RESULT IN SIGNIFICANT <br /> ENVIRONMENTAL HARM OR HARM TO THE PUBLIC HEALTH AND SAFETY. THIS <br /> DEMONSTRATION SHALL BE COMPLETED AND A REPORT SUMMARIZING THE RESULTS <br /> AND METHODOLOGY THEREOF SUBMITTED TO THE DIVISION FOR REVIEW BY DECEMBER <br /> (r_ 31, 1981. <br />
