-34-
t
WITHIN 60 DAYS OF PERMIT ISSUANCE, COLORADO WESTMORELAND, INC.
MUST PROVIDE THE DIVISION WITH A SPECIFIC CROP PRODUCTION STAN-
DARD FOR THE ORCHARD AREA. PENDING DIVISION APPROVAL, THIS
STANDARD WILL BE USED IN EVALUATING REVEGETATION SUCCESS
WITHIN THE ORCHARD VEGETATION TYPE.
The applicant has proposed a shrub/tree restocking rate of 180 plants
per acre, but has not proposed a density standard with which to evalu-
ate the success of shrub/tree revegetation. It is understood by the
Division that shrub/tree densities on the reclaimed surface will not
be returned to pre-mining levels, due to the post-mining land use
objective of grazing land for livestock and wildlife. However, an
appropriate, justifiable density standard needs to be developed and
submitted to the Division for approval, based upon recommendations
from the Division of Wildlife for minimum shrub densities for wildlife
grazing and habitat needs.
WITHIN 60 DAYS OF PERMIT ISSUANCE, COLORADO WESTMORELAND, INC.
MUST PROVIDE THE DIVISION WITH AN APPROPRIATE, JUSTIFIABLE SHRUB/
TREE DENSITY STANDARD WHICH WILL BE SUFFICIENT TO MEET THE
APPROVED POST-MINING LAND USE FOR THE RECLAIMED SURFACE. THIS
STANDARD MUST BE BASED UPON A RECOMMENDATION FROM THE DIVIS-
ION OF WILDLIFE, AND MUST INCLUDE THE FINDINGS OF THE
TECHNICAL REFERENCES/SOURCES USED TO ESTABLISH THIS STANDARD.
