Box 191 <br />Victor, CO 80860 <br />Re: Cresson Project; DRMS File No. M- 1980 -244; <br />Technical Revision (TR -65) Approval <br />Dear Mr. Corner: <br />On August 6, 2012 the Division of Reclamation, Mining and Safety (Division) partially approved the <br />Technical Revision application submitted to the Division on June 28, 2012, addressing the following: <br />Based on discussions between CC &V and the Division, and the formal withdrawal of the proposal to reduce <br />the sampling frequency of overburden fill placement, the proposed revised Specification Change for <br />Overburden Fill Testing Frequency is not incorporated into this Technical Revision (TR -65). <br />The terms of the Technical Revision No. 65 VLF phase 5 berm raise design approved by the Division are <br />hereby incorporated into Permit No. M -1980 -244. All other conditions and requirements of Permit No. M- <br />1980 -244 remain in full force and effect. <br />The Division has reviewed this minor change for impacts to the financial warranty. The cost for reclamation <br />of the VLF Phase 5 berm raise is included in Amendment 9, Volume VII, Appendix 11. Therefore, no <br />additional financial warranty for this Technical Revision is necessary. The last revision requiring adjustment <br />to CC &V's surplus warranty was TR -60.
