Cunningham <br />Environmental Protection Specialist <br />Division of Reclamation, Mining and Safety <br />Department of Natural Resources <br />1313 Sherman Street, Room 215 <br />Denver, Colorado 80203 <br />DECEIVED <br />AUG G Z <br />Division of Reda nation, <br />Mining & Safety <br />Re: Notice of 110(2) Hard Rock /Metal Mining Reclamation Permit Application Consideration Destiny Mining, <br />LLC, Destiny Pit, File No. M- 2009 -056 (CHS #62424) <br />Dear Mr. Cunningham: <br />Thank you for your correspondence dated July 23, 2012 (received by our office on July 25, 2012) regarding the <br />subject project. <br />Following our review of the documentation provided, it appears that the proposed permit area was surveyed for <br />cultural resources in 2009 by archaeological staff with the Bureau of Land Management (BLM) Royal Gorge <br />Field Office. According to the 2009 BLM survey report titled "Cultural Resources Inventory for the Fairplay <br />Destiny Placer Mine" and subsequent evaluation documented within "Archaeological Testing at Site 5PA4410, <br />Park County, Colorado' one historic -period archaeological site (5PA4410) was identified within the permit area. <br />However, consultation between the BLM and our office determined this site as not eligible for the National <br />Register of Historic Places. As such we believe that a finding of no historic properties affected is appropriate <br />for the subject permit application. <br />The consultation process does involve other consulting parties such as local governments, Tribes, and the BLM, <br />which as stipulated in 36 CFR 800.3 are required to be notified of the undertaking. Additional information <br />provided by the local government, Tribes or other consulting parties may cause our office to re- evaluate our <br />comments and recommendations. <br />If previously unidentified archaeological resources are discovered in the course of the project, work must be <br />interrupted until the resources are properly evaluated in terms of the National Register of Historic Places <br />eligibility criteria (36 CFR 60.4) in consultation with our office. <br />Thank you for the opportunity to comment.
