MANAGEMENT <br />As you know, construction at the Fruita Loadout has been delayed. The loadout will be <br />constructed after the McClane Canyon Mine obtains a coal sales contract. The McClane <br />Canyon Mine is not expected to acquire a coal sales contract in the foreseeable future. <br />The permit has the following water monitoring requirements: <br />Alluvial wells RWA through RW -4 and surface water monitoring stations US -RW, DS -RW, US- <br />LD, and L -DS -LD are monitored quarterly. Field parameters are measured each quarter. A full <br />suite sample is obtained semi - annually during the second and fourth quarters. <br />CAM - Colorado, LLC (CAM) hereby requests temporary relief from the permit water monitoring <br />requirements. Water monitoring will be reinitiated one year before the loadout is operational. <br />The reasons for this request for relief are as follows: <br />1. Baseline water monitoring data has been collected. With the exception of L -DS -LD all <br />water monitoring stations have been monitored for ten quarters with a full suite analysis <br />for eight quarters. Station L -DS -LD has been monitored for seven quarters with a full <br />suite analysis for six quarters. <br />2. The construction of the loadout may be delayed for many years. <br />3. The cost of each monitoring event is over $3,000. <br />Enclosed are the monitoring data accumulated through the second quarter of 2012. Please let <br />CAM know if it can process a technical revision to obtain temporary relief from water monitoring. <br />Sincerely, <br />G <br />J Stover P.
