OBSERVATIONS <br />PERMIT #: M- 1991 -123 <br />INSPECTOR'S INITIALS: PSH <br />INSPECTION DATE: July 31, 2012 <br />The Idaho Creek Resource site was inspected by Peter Hays with the Division of Reclamation, Mining and <br />Safety (Division) in response to a request for full reclamation and financial release (SL -01) of the site. Mr. <br />William Kobobel was notified of the inspection, but due to a misunderstanding on which site Mr. Kobobel <br />intended to release was not present during the inspection. <br />Mr. Kobobel submitted a full financial and performance warranty release request (SL -01) for the site on June <br />25, 2012. Per Rule 4.17.2(2), the Division is required to inspect the lands and reclamation described in the <br />notice to determine if the Permittee has complied with all applicable requirements within sixty (60) days after <br />receiving the notice. <br />The Division currently holds a financial warranty of $15,610, which is adequate to complete the reclamation of <br />the site based on the observations from this inspection. <br />The Division will deny the Full Financial and Performance Warranty release request (SL -01) for the Idaho <br />Creek Resource site due to the lack of an approved permanent augmentation plan for the site. <br />The purpose of this inspection was to evaluate the site for reclamation completion and revegetation success. <br />The site was previously inspected by the Division on August 31, 2009. The site appeared unchanged since the <br />previous inspection with the expection of the following two items. <br />A boat dock has been constructed in the southwest corner of the lake. The dock is not included in the <br />approved reclamation plan for the site. The Division will not require the Operator to submit a technical <br />revision to include the dock in the reclamation plan, since the approved post mining land use is recreation and <br />the dock is consistent with this use. <br />Concrete rubble has been placed along the east and north shorelines of the lake, presumably to prevent <br />shoreline erosion. Vertical shoreline erosion of one to two feet in depth was observed during the inspection. <br />The shoreline erosion is typical of open water lake used for recreation with 3H:1V shoreline slopes. The <br />Division's files do not indicated the Operator has submitted an inert fill affidavit for the concrete rubble <br />backfill. The Division will require the Operator to either remove the concrete from the shoreline or submit an <br />affidavit certifying the material is clean and inert as define by Rule 1.1(20) and required by Rule 3.1.5(9)(c) <br />prior to any future release request considerations by the Division. <br />The vegetation around shoreline and surrounding areas was well established with only small areas of sparse <br />vegetation noted during the inspection. Noxious weeds, Canada and Scotch Thistle, were observed during the <br />inspection, but evidence of chemical treatment was observed and the weeds seemed to be well controlled by <br />the Operator. <br />The Division received comments from the Colorado Division of Water Resources in response to the release <br />request notice. A copy of the letter was given to Mr. Kobobel following the inspection. In the letter the <br />Division of Water Resources states Mr. Kobobel has filed an application with the water court under case no. <br />05CW320 for an augmentation plan to replace the depletions resulting from evaporation off the gravel pit <br />lake. A proposed decree was filed with the court on May 30, 2012, however the final augmentation plan has <br />Page 2 of 4 <br />
