The second quarter sediment pond inspection reports and the pond capacity data were received
by the Division on July 6, 2012. Sediment pond inspections were conducted by TMI on June 12, 14, 18
and 19.

This report appears to be in compliance with the applicable sections of Rule 4.05.9. Animal burrows
were reported as being observed and repaired on the embankments of several of the ponds. The report
lists the sediment ponds that need to be cleaned.

Thank you for responding to the Division’s concerns identified in the review of the first quarter
sediment pond inspection report.

If you have any questions feel free to contact me at (303) 866-3567 ext. 8120.

Sincerely,

Jared Ebert
Environmental Protection Specialist, DRMS

Office of Office of

Mined Land Reclamation Denver • Grand Junction • Durango Active and Inactive Mines
