As specified in the site inspection report dated June 28, 2012 and in the Release
Objection Letter received by DRMS from the State Engineer's office, there are still exposed water issues
that will need to be resolved before the proposed partial release can be approved. The Division has received
no documentation that these issues have been resolved. Therefore, the Division must find that reclamation
has not been satisfactorily accomplished on these areas and deny this partial release request.
In addition, unless Holcim can provide documentation of compliance with the requirements of the April 30
2010 letter addressing requirements for exposed groundwater at mining sites, the Division will have no
choice but to pursue enforcement action soon. If you have any questions, please contact me.
Sincerely,
Eric C.
