March 6 2012 — The Division sent the Operator a Notice of Possible Violation for failure to first <br />obtain from the board or office a reclamation permit prior to engaging in a new operation. <br />April 11 2012 — The Board found the Operator in violation of C.R.S. 34- 32.5- 109(1) for failing <br />to obtain a reclamation permit prior to engaging in a new operation. The Operator was ordered to <br />provide all materials necessary for a 112c conversion application to secure a reclamation permit <br />for all areas affected by the mining operation and to submit such conversion application with all <br />materials in an approvable form within 90 days of the effective date of the Order. In addition, the <br />Operator was ordered to pay a civil penalty in the amount of $45,000. All but $500 of the civil <br />penalty was suspended if the Operator complied with the corrective action in the time specified. <br />The unsuspended portion of the civil penalty was due and payable within 30 days of the effective <br />date of the Order. <br />May 9 2012 — The Operator submitted the unsuspended portion of the civil penalty. <br />July 25 2012 — The Operator submitted a request for an extension of the Board order deadline <br />for complying with the corrective action. The extension request was received prior to the deadline <br />of July 30, 2012. <br />STAFF RECOMMENDATION: <br />The Division recommends the Board approve the Operator's request to extend the corrective <br />action due date from July 30, 2012 to September 14, 2012.
