Division has advised that Sheep Mountain failed to timely request the necessary Board hearing. <br />See Recommendation, at 2. <br />8. Second, any consideration of the JD -8 Mine's intermittent status is inconsistent <br />with the EPP process. The purpose of the EPP process is to meet the requirements of Rule <br />6.4.21 and to update portions of the JD -8 Mine permit, not to question the Division's prior <br />approval of intermittent status. The EPP process is neither the time nor proper procedure to <br />criticize Division decisions made more than a decade ago or to present legal arguments regarding <br />how the Division should be implementing its intermittent status and temporary cessation rules. <br />Conclusion <br />For the above reasons, this Board should issue an order excluding from this proceeding <br />any evidence, argument, and discussion of whether the JD -8 Mine is lawfully in intermittent <br />status. <br />Respectfully submitted this 27th day of July, 2012. <br />BRYAN CAVE HRO <br />By: <br />Charlotte L.
