2011). Colowyo originally requested that 987.32 acres be Phase III Bond Released. Specifically <br />excluded from the Phase III bond release decision are 7.8 acres for permanent drainages, Streeter <br />Drainage, Gulch A, and South Streeter Ditch, that continue to receive runoff of areas that have not <br />been approved for Phase III bond release, and topsoil stockpile 15G. <br /> <br />Phase III <br /> <br />Colowyo has requested a release of $5,000,000.00 for the partial Phase III Bond Release areas <br />included in the SL-05 application. The Division was unable to find any explanation or computation <br />in the SL-05 bond release application regarding Colowyo’s request for release in the amount of <br />$5,000,000.00. The Division proposes to release $692,320.04 of reclamation liability. This value <br />was derived by calculating the cost of the reclamation tasks proposed to be released with the <br />approval of SL-05 using the Division’s CIRCES program. The Division evaluated Colowyo’s <br />reclamation Cost Estimate (Exhibit 13A of the Permit) to assure that adequate reclamation bond is <br />retained for all remaining reclamation and maintenance tasks in accordance with the approved <br />reclamation plan The remaining reclamation liability, after the proposed release for SL-05 and as <br />updated for current costs, will be $68,825,509.96. Table 1 provides a summary of the SL-05 bond <br />release amounts. <br /> <br />The Division proposes to approve Phase III Bond Release on 979.52 acres of the Colowyo Mine <br />disturbed area; 924.60 acres in the East Pit and 54.92 acres in the West Pit. Table 2 shows the <br />disturbed area acreage and all bond released acreages to date. <br /> <br />The proposed amount to be released for the partial Phase III Bond Release is 100% of the full <br />required surety for the applicable area pursuant to Rule 3.03.1(2) (b). A summary of the original <br />liability amounts and all bond releases to date is presented in Table 3. The remaining <br />$68,825,509.96is sufficient to complete all remaining reclamation work at the site if the work had <br /> <br />to be performed by the Division, including the cost of the remaining backfilling and grading, <br />drainage control reestablishment, topsoil redistribution, initial vegetation establishment and <br />reestablishing vegetation on any revegetated areas, should those areas fail. <br /> <br />Any person with a valid legal interest which might be adversely affected by this proposed decision <br />may request a formal public hearing before the Mined Land Reclamation Board in accordance with <br />Rule 3.03.2(6). Public notice of this proposed decision will be published twice in the Craig Daily <br />Press as soon as possible. Requests for public hearing must be submitted to the Division in writing <br />within thirty days of the first publication in the Craig Daily Press.
