We understand that the 150 -day timeframe is premised on the application being deemed complex <br />thereby providing additional time, in this instance an additional 30 days, to the standard 120 -day decision <br />timeframe. We agree with your reasoning that a delay from the August 2012 Board meeting will provide <br />for a more orderly and thorough review of the CC &V responses to DBMS' Adequacy Review Comments <br />that we anticipate receiving from DRMS in the near future. <br />CC &V is willing to extend the decision timeframes in order to have a DRMS decision timely issued to <br />accommodate the September Board meeting (scheduled for September 12 -13, 2012). As we have <br />described to DRMS, the MLE2 Project schedule is critical with construction of the High Grade Milling <br />facility needing to start no later than October 1, 2012.
