Hickenlooper <br />Governor <br />Mike King <br />Executive Director <br />Loretta Pineda <br />Director <br />RE: File M- 1977 -493; Climax Mine; Technical Revision 22 (TR22) — North 40 and McNulty OSF Design and <br />Monitoring Plan and Modification to Ceresco Ridge Haul Road Annual Alignment Adequacy Review <br />Mr. Lazuk: <br />The Division of Reclamation, Mining and Safety received Technical Revision 22 — North 40 and McNulty OSF <br />Design and Monitoring Plan and Modification to Ceresco Ridge Haul Road Annual Alignment for the Climax <br />Mine on June 1, 2012. This TR has been submitted to satisfy the conditions placed on the MLRB approval of <br />AM06. The decision date for this revision has been extended to July 30, 2012. Please be advised that if you are <br />unable to satisfactorily address any concerns identified in this review before the decision date, it will be your <br />responsibility to request an extension of the review period. If there are outstanding issues that have not been <br />adequately addressed prior to the end of the review period, and no extension has been requested, the Division <br />must deny this revision. <br />DRMS has completed the initial adequacy review of TR22. As with most revisions of this scope and complexity, <br />there are a several items that will require clarification of the existing information or submittal of additional <br />information. Several, if not all, of these items were discussed in a very productive July 17"' 2012 meeting <br />between Climax, Golder and DRMS. <br />DRMS anticipates that as mining continues at this site that development of OSFs will evolve based on the <br />implementation of additional items and best practices, the collection of additional data, field conditions, and <br />ongoing discussions between DRMS and Climax. Although Climax is certainly aware, DRMS would also like to <br />reiterate at this time that, as EPF's, the design and construction of these facilities is subject to all the requirements <br />of Sections 7.3 and 7.4 of the Hard Rock/Metals Mining Rule. The annual report for the Climax mine will also be <br />required to include at least annual stability monitoring/certification by a qualified engineer for all operating <br />OSF's. DRMS has no objections /issues with the proposed realignment of the Ceresco ridge haul road as proposed <br />in TR22. <br />Tie -in to existing OSF(s) <br />How will Climax "tie -in" the proposed OSF construction and water management plans with the existing North 40 <br />and McNulty Gulch OSFs? Please clarify with appropriate text/maps how drainage from the existing OSFs will <br />be captured and integrated into the proposed operational OSF design.
