Berry, David
From: Chris Kamper [CKamper @cksmb.com]
Sent: Monday, July 09, 2012 5:30 PM
To: Berry, David; rlwade @wfcnucla.org
Cc: Jeff Fugate
Subject: RE: Turner FAX
Attachments: Morgan May 2012 006 (4).jpg; Morgan May 2012 008 (4).jpg; Morgan May 2012 012 (3).jpg
David,
Having reviewed the fax, I do not perceive any allegations that have not been addressed in WFC's prior responses to the
Division concerning this issue. I believe these were all put to rest by the Division's aerial inspection and the report that
was generated by Marcia Talvitie dated April 2, 2012. WFC can confirm, as stated in the inspection report, that the only
Bench One materials that have been placed at the bottom of the pit are the exceptionally rocky materials that Talvitie
observed being placed there during her inspection. That practice has been continued.
As stated in the permit discussion of these materials, Bench One is a mix of soils, some of which are rocky, some of
which are less so. The attached photos show some of the materials WFC has encountered recently, and which were
placed towards the bottom of the pit.
Best regards,
Chris
CHRISTOPHER KAMPER
CARVER SCHWARZ MCNAB +BAILEY LLC
1600 Stout Street, Suite 1700, Denver CO 80202
direct 303.893.1825 1 main 303.893.1815 1 fax 303,893,1829
ckamaer @cksmb.com
If you are not the intended recipient of this email, please delete it from your system immediately Use of the
information contained in this email by anyone other than the intended recipient is strictly prohibited
From: Berry, David [mailto:David.Berry@state.co.us]
Sent: Monday, July 09, 2012 1:04 PM
To: rlwade @wfcnucla.org; Chris Kamper
Cc: Jeff Fugate
Subject: Turner FAX
Hello Lance and Chris — I attach one of the latest Turner notes for your review and comment.
Please let us know of your position relative to the allegations contained in the note.
Thanks,
David Berry
1
