Cunningham <br />Environmental Protection Specialist <br />Colorado Division of Reclamation, Mining and Safety <br />1313 Sherman St., Rm. 215 <br />Denver, CO 80203 <br />Dear Mr. Cunningham: <br />RE: Jenkins Site; DRMS File No. M -1977 -393; Follow-up on Unresolved Problems <br />M <br />This letter is in response to your letter of May 1, 2012 to Mr. Robert Crifasi of my staff on to request <br />regarding the Jenkins Site; DRMS File No. M- 1977 -393. The City of Boulder (Boulder) has continued <br />reclamation activities at this site during the past year. Reclamation activities include grading and filling <br />the pit. <br />Boulder wishes to complete reclamation at the site in the most expedient manner possible. However, <br />the time window for doing on- the — ground reclamation activities is constrained by the presence of a bald <br />eagle nest approximately one -half mile from the reclamation site. Over the past decade, Boulder in <br />consultation with the US Fish and Wildlife Service has implemented a property closure a between <br />November 1 and July 31 of each year as a protective measure to protect nesting bald eagles. The closed <br />area extends one -half mile from the nest which puts part of the Jenkins within the closed area. For this <br />reason, the city only has a three month window to conduct reclamation activities and remain in <br />compliance with the bald eagle closure. Consequently, Boulder is requesting a five year extension of the <br />corrective action date as reclamation on the Jenkins Site remains ongoing. <br />Thank you very much for your attention to this permit.
