6. The Division inspected the site on March 27, 2012. Parties who <br />submitted comments on the Application attended the inspection. <br />7. On April 3, 2012, the Applicant submitted further engineering <br />information related to concerns about drainage at the site. <br />8. On April 18, 2012, the Division performed an engineering review of <br />the site. The Division identified a number of outstanding issues at the site <br />related to drainage and water management. <br />9. The decision deadline on the Application is May 20, 2012. <br />10. At its May 2012 meeting, the Board approved Applicant's first <br />request to extend the decision date by sixty (60) days beyond May 20, 2012, to <br />July 19, 2012. <br />11. On June 19, 2012, the Applicant submitted a letter requesting a <br />second sixty -day extension. <br />12. The Division recommends that the Board approve Applicant's <br />second request to extend the decision date by sixty (60) days beyond the current <br />deadline. <br />CONCLUSIONS OF LAW <br />13. The Board has jurisdiction over this matter pursuant to the Colorado <br />Land Reclamation Act for the Extraction of Construction Materials, Article 32.5 of <br />Title 34, C.R.S. (2011) ( "Act "). <br />14. Under Rule 1.4.1(9) of the Mineral Rules and Regulations of the <br />Colorado Mined. Land Reclamation Board for the Extraction of Construction <br />Materials, the Division's review time on an application may be extended up to 365 <br />days beyond the date the application was filed. The Division and the Board have <br />discretion to extend that decision date. An extension is warranted and necessary to <br />allow the Applicant additional time to address the concerns of the Division and the <br />parties. <br />ORDER <br />Based on the foregoing findings of fact and conclusions of law, the Board <br />hereby APPROVES the Applicant's request to extend the decision deadline for the <br />Application to sixty (60) days beyond the current decision deadline of July 19, 2012. <br />Oldcastle SW Group, Inc. <br />Animas Glacier Gravel, M- 2011 -028 2 <br />
