Pineda <br />Director <br />I am requesting the preparation of a proposed civil penalty assessment for Notice of Violation (NOV) CV -2012- <br />005, issued to C. B. Minerals Company, LLC for the Coal Ridge No. 1 Mine. NOV CV- 2012 -005 was issued <br />on June 26, 2012 for constructing an unapproved sediment collection ditch located uphill and south of the <br />mine's single sediment pond. <br />During the March 19, 2012 inspection, it was noted that erosion and slumping had occurred to the embankment <br />around the sediment pond's Culvert C5 outlet and was in need of maintenance. Sometime between the March <br />19, 2012 and June 19, 2012 field inspections, a contractor hired by the permittee performed maintenance to this <br />embankment. In conjunction with discussions with Mr. James Stover, the permitting contact, it appeared that <br />during the time of embankment maintenance the contractor constructed the unapproved ditch to direct surface <br />runoff to Ditch 3 to help prevent further erosion and slumping around Culvert C5's outlet. Mr. Stover indicated <br />that neither he nor the permittee had directed the contractor to construct the ditch. During the construction of the <br />sediment collection ditch, it appears that topsoil was neither salvaged nor properly stored. The unapproved <br />ditch runs northwest toward the sediment pond and is approximate 150 feet long, 1.5 feet deep and 1.5 feet <br />high. Additionally, it should be noted that the ditch is constructed within an area where a phase two bond <br />release has been previously approved. <br />In the past 12 months, no violations have been issued to C. B. Minerals Company, LLC for the Coal Ridge No. <br />1 Mine. <br />There are two steps necessary to abatement NOV CV- 2012 -005. The two steps are: 1) Regrade, re- topsoil and <br />re -seed the unapproved sediment collection ditch located uphill and south of the sediment pond by July 16, <br />Office of Office of <br />Denver • Grand Junction • Durango Active and Inactive Mines <br />
