Cc: Zuber, Rob

Subject: RE: TR-65

Hi Tamme –

I sent the Division’s second adequacy review for TR-65 to our Admin. staff on June 28, 2012 and it should have been
mailed shortly after. It appears there may have been some miscommunication or mailing error on our part and
unfortunately our Admin. personnel in charge of mailing is currently out of the office. I have attached the adequacy
review and bond estimate related to New Elk’s TR-65 and will make sure a hard copy is to follow.

With New Elk’s TR-65 decision due date being July 13, 2012, it appears that a request for extension will be need to
provide enough time for New Elk Coal Company, LLC to respond and for the Division to review New Elk’s responses.

Additionally, the Division’s preliminary adequacy review for TR-66 should have been sent on June 29, 2012. To ensure all
letters have been properly mailed, has New Elk Coal Company, LLC received the adequacy review for TR-66?

I apologize for the delay and if you have any questions, please feel free to contact me.

Thanks,

Zach Trujillo
Environmental Protection Intern
Division of Reclamation, Mining and Safety
1313 Sherman Street, Room 215
Denver, CO 80203
303-866-3567 x8164
Zach.Trujillo@state.co.us

From: Tamme Bishop [mailto:tamme.jestover@bresnan.net]
Sent: Wednesday, July 11, 2012 2:07 PM
To: Zuber, Rob
Cc: jestover@bresnan.net; Trujillo, Zach
Subject: RE: TR-65

Hi Rob. We did not receive a second adequacy letter for TR-65. The only comments we've seen were what we
downloaded from LaserFiche, your interoffice memo to Zach dated 6-26-12. When was the letter sent?

Tamme Bishop, P.E.
JE Stover & Associates, Inc.
2352 N. 7th Street, Unit B
Grand Junction, CO 81501
970-245-4101
From: Zuber, Rob [mailto:Rob.Zuber@state.co.us]
Sent: Wednesday, July 11, 2012 2:03 PM
To: Tamme Bishop
Cc: jestover@bresnan.net; Trujillo, Zach

Subject: TR-65

2
