Permitting Actions Processed Since July 2010 Midterm Permit Review <br />Technical Revisions <br />TR -60 proposed approval decision was issued May 5, 2011. The revision changed the revegetation success <br />criteria for vegetation cover, herbaceous production and species diversity. Snowcap Coal Company, Inc <br />demonstrated that these changes were warranted based on Vegetation Sampling and re- evaluation in 2010. <br />TR -61 proposed approval decision was issued June 20, 2011. The revision provided plans for the removal of <br />Pond 8 and 9 at the South Portal and Pond 7 and other drainage control features at the North Decline. The <br />revision provided demonstration that these drainage control features are no longer necessary. <br />TR -62 proposed approval decision was issued November 8, 2011. The revision changed the permit boundary <br />and associated acreages to reflect approvals of SL -5, SL -6, and SL -7 Bond Releases. Snowcap Coal Company, <br />Inc was also given approval to suspend surface water monitoring point SWGS -08 and approval to retain <br />specific diversion ditches located at the North Decline as permanent features. <br />Minor Revisions <br />MR -76 proposed approval decision was issued January 12, 2011. The revision added language to the permit <br />document regarding final quarterly inspections by the operator at Roadside Refuse Disposal Area, Cameo <br />Refuse Disposal Area #1 and Cameo Refuse Disposal Area #2. <br />MR -77 proposed approval decision was issued April 26, 2012. The revision added the location of a new 2" <br />natural gas line to be installed at the South Portal. The installation of the gas line will re- disturb an area <br />approximately 240' long by 5' wide across the reclaimed Pond 8 area. The new disturbance will be graded and <br />re- seeded. Exhibit 6C will be revised accordingly to show the location of the gas line. <br />Liability Release Actions <br />SL -6 proposed approval decision was issued November 4, 2010. The final decision was issued December 14, <br />2010. Snowcap Coal Company requested release of Phase II and III of bond liability on 14.8 reclaimed acres <br />of its total 3,016 acres within the permit boundary at the Roadside North and South Portals Mine. The purpose <br />of this Bond Release Request was to release those lands within the permit boundary located at the South Portal <br />and having a designation of Industrial as the post - mining land use. The 14.8 acres have been fully reclaimed <br />and an Industrial land use has been implemented. <br />SL -7 proposed approval decision was issued March 21, 2011. The final decision was issued April 26, 2011. <br />Snowcap Coal Company requested release of Phase I, II, and III bond liability on 75.2 reclaimed acres of its <br />total 3,016 acres within the permit boundary at the Roadside North and South Portals Mine. The purpose of <br />this Bond Release Request was to release those lands within the permit boundary located at the Unit Train <br />Loadout, Permanent Flood Control Dike, Railroad Spur and Overland Conveyor lying north of I -9/10 Road and <br />having a designation of Industrial as the postmining land use. The 75.2 acres have been fully reclaimed and an <br />Industrial land use has been implemented. <br />Permit Revision No. 5 Review Process <br />Snowcap Coal Company submitted an application for Permit Revision No. 5 on March 8, 2012.
