Between 2000 and 2003 several other disturbed areas were fully reclaimed, including the 2 West <br />Portals, South Fan, "B" Substation, the major portion of refuse area CRDA -1, entirety of CRDA -2, the <br />CBA -1 and RSRDA Soil Borrow Areas, and northern segment of the overland conveyor corridor. Soil <br />Borrow Area CBA -2 was fully excavated and interim reclamation was completed. Final grading of <br />CBA -2 will occur in conjunction with removal of Sediment Pond 11. Interim reclamation of the Coal <br />Creek permanent diversion channel between the upper dip section culverts and the large double <br />culverts beneath Haul Road 4 was completed in 2002. <br />Phase 1 bond release (SL -02) was approved in August 2003 for various disturbance areas. The <br />decision documented backfilling and grading compliance for CRDA -2 and most of CRDA -1 <br />(excepting the temporary road left open for further disposal), RSRDA slopes, Soil Borrow Area CBA - <br />1 and the RSRDA Soil Borrow Area, South Fan disturbances, 2 West Portal disturbances, "B" <br />Substation Site, the North Decline, the North Portal Facilities (excepting certain remaining support <br />facilities and future drainage channel construction), and various other miscellaneous areas. Please <br />refer to the SL -02 fmdings document for additional detail. <br />As described below in greater detail under the Alternative Land Uses section, The Unit Train Loadout <br />(UTL) has been backfilled and graded and entirely reclaimed. The Unit Train Loadout was converted <br />to industrial use with approval of PR -4. The rail loop and a portion of the rail spur were left in place <br />as a key feature for the future industrial use of the area. The final contours for the UTL are shown on <br />Exhibit 11C of the PAP. Cross sections representing the existing and final grades are shown on <br />Exhibit 59. Grading of the site involved eliminating the sewage treatment ponds, eliminating most of <br />the embankment that supported the linear stacker and coal stockpile and backfilling the sediment <br />ponds. During the process of grading, light use roads 3 and 5 and portions of light use road 4 and <br />haul road 3 would be eliminated. Following approval of PR -4 (February, 2009) SCC finalized a <br />purchase and sales agreement and sold the loadout property to Halliburton. SCC was given full <br />release of bond liability for the train loadout and overland conveyor areas with approval of SL -07 in <br />2011. TR -62 was approved in November 2011 allowing SCC to modify the permit area by removing <br />these locations from within the permit boundary. <br />VIII. Permits Incorporating Variances from Approximate Original Contour Restoration Requirements for <br />Steep Slope Mining. <br />Steep slopes as defined in Rule 1.04(125) exist in the South Portal disturbed area and they are <br />depicted on Exhibit 6C. As allowed for in Rule 2.06.5, SCC requested an AOC variance (PR -3) for <br />these steep slopes to allow for an alternative commercial postmining land use. <br />Within PR -3, SCC requested, and the Division approved, a variance from the approximate original <br />contour restoration requirements for steep slope mining, pursuant to Rules 2.06.5 and 4.27.4. <br />Approval of the variance has allowed SCC to retain the flat mine bench, the existing shop and <br />warehouse, an access road and parking areas for the approved commercial postmining land use at the <br />South Portal facilities area. The specific findings required by Rule 2.06.5 and by Rule 4.27.4 for the <br />South Portal area are provided in Section B. VIII of the Proposed Decision and Findings of <br />Compliance for Permit Revision No. 3 dated July 30, 2007. <br />Permit Revision No. 5 41 July 10, 2012 <br />
