Proposed Decision <br />The Colorado Division of Reclamation, Mining and Safety proposes to approve an application for a permit <br />revision (PR -5). The revision application was submitted to the Division on March 8, 2012 and deemed <br />administratively complete on March 13, 2012. The application was submitted by Snowcap Coal Company, <br />Inc., to gain approval for the removal of Ponds 6, 10, 11 and 13 along with other drainage control features at <br />CRDA 1 & 2, CBA 1 & 2 and the North Portal. This revision also seeks approval to make changes to the final <br />reclamation plans of Ponds 6, 10, and 11, Coal Gulch, the Coal Canyon drainage and Roadside North Portal. <br />This decision is based on a fmding that the operation will comply with all requirements of the Colorado State <br />Program as found in the Colorado Surface Coal Mining Reclamation Act, C.R.S. 34 -33 -101 et seq., and the <br />Regulations promulgated pursuant to the Act. If no request for a formal hearing is made within thirty (30) days <br />of the first publication of the issuance of this proposed decision, then this decision becomes final. The <br />Division currently holds an adequate surety bond in the amount of $1,005,256.00. The permit revision <br />application and all supporting documentation will become a binding part of the permit. All previous <br />stipulations and conditions have been terminated or complied with and there are no new stipulations added <br />with Permit Revision No. 5. <br />Permit Revision No. 5 2 July 10, 2012 <br />
