Hickenlooper <br />Governor <br />Mike King <br />Executive Director <br />Loretta Pineda <br />Director <br />GCC Energy has requested an extension to the abatement deadline beyond 90 days of issuance for Notice <br />of Violation No. CV- 2012 -003 as allowed by Rule 5.03.2(2)(c). GCC is diligently working toward <br />abatement of the NOV as discussed in the attached letter. Trautner Geotech was hired immediately after <br />the NOV was issued to evaluate the coal mine waste deposited at the west portal bench. Field work has <br />been completed and Truatner is preparing a final report detailing their findings. The report will be <br />submitted to the Division no later than July 27, 2012. <br />Based on the field work conducted, it has been determined that several areas of the coal mine waste as <br />currently placed do not meet the performance standards for compaction. Given the inadequate <br />compaction, GCC plans to submit a Technical Revision which will detail the necessary designs for the <br />coal mine waste to meet the performance standards criteria. The TR will provide plans for underdrains, <br />slope stability, final grade, final revegetation and other standards as required. GCC will work with <br />contractors to ensure the coal mine waste on the portal bench will either be relocated to the approved <br />refuse pile or rehandled so that the material will achieve all performance standards. <br />GCC has requested that the relocation and /or reconstruction of the coal mine waste on the portal bench <br />will be completed by November 30, 2012. However, Rule 5.03.2(2)(c)(g) limits an extension to 90 days. <br />Therefore, I recommend that the final abatement deadline be set at October 8, 2012.
