Surface Water Impacts <br />All of the runoff from the SL -05 areas flows into one of the following sediment ponds: Streeter Pond, the <br />Gulch A Pond, or the West Pit Pond. All of these ponds are inspected on a regular basis by the Division <br />as well as CCC. All of these ponds have been found to be in good repair and properly functioning, <br />although routine maintenance is occasionally required. None of these ponds are included in the SL -05 <br />Bond Release application. Recent Division reviews of AHRs and DMRs indicate that there have <br />been no significant water quality problems at the discharge points associated with these ponds. <br />All three ponds are associated with outfalls in Colorado Discharge Permit System permit number <br />CO- 0045161. Exceedances of discharge limitations that have not been the result of runoff (when <br />alternate limitations were in effect) have been very rare and not indicative of a threat to water <br />quality. <br />There are eight stock tanks located in the Phase III Bond Release area (A, B, C, D, E, F, L and M). CCC <br />has provided written documentation that: <br />• The criteria for permanent impoundments have been met pursuant to Rule 4.05.9(13). <br />• These stock tanks are acceptable to the State Engineer's Office. <br />• The landowner has requested that the stock tanks remain as permanent structures. <br />CCC has submitted a technical revision to the permit to include the stock tanks as permanent structures <br />(TR -89). This technical revision was approved by the Division on March 18, 2011. <br />During the bond release inspection in August 2010, the SL -05 Phase III Bond Release areas in the East <br />Pit were all inspected to ensure that they have met the requirements for drainage control reestablishment. <br />The following ditches were inspected for SL -05: Gulch A Ditch, Section 11 Ditch, the Southeast <br />Tributary to Streeter Ditch, and the Southwest Tributary to Streeter Ditch. Gulch A is excluded from the <br />SL -05 area because it receives runoff from areas in the SL -05 area as well as areas not included in the <br />bond release area. The other ditches have drainage areas entirely within the Bond Release area, and these <br />ditches are included in the SL -05 area. No problems were noted with side - cutting along the lengths of the <br />ditches. All ditches were found to meet design criteria, including: <br />• Ditch elevations along the profile <br />• Lateral locations <br />• Cross section dimensions <br />• Riprap size. <br />Other ditches in the East Pit area (including the East Side Collection Ditch, the Streeter South Side Ditch <br />and Streeter Ditch) were not inspected during the bond release inspection, but they have been inspected <br />by the Division at other times and found to be in good repair. These were not included in the SL -05 area <br />because they receive runoff from areas in the SL -05 area as well as areas not included in the bond release <br />area. <br />The portion of the West Pit that is included in the SL -05 bond release area includes portions of the <br />drainage areas for East Taylor Pond Ditch, the West Pit Coal Road Ditch and the West Pit Fill Ditch. <br />However, all three of these ditches also convey flow from areas not included in the SL -05 application and <br />are therefore excluded from the SL -05 Bond Release. <br />As stated by CCC in the response to the Division's review of the 2007 — 2009 AHRs, a limited <br />number of low impact spoil springs are expected to develop occasionally, but the aerial extent of <br />these and the low level of flow (sometimes non - existent flow) will have a very minor impact on <br />
