DATE:
TO:
CC:
FROM:
RE:
DEPARTMENT OF NATURAL RESOURCES
DIVISION OF WATER RESOURCES
Response to Reclamation Permit Release Request Consideration
July 5, 2012
Michael A. Cunningham, Environmental Protection Specialist
Division 1 Office, District 6 Water Commissioner
Sarah Brucker, P.E.
Deepe Farm Pit, File No. M- 1981 -302
Operator: The Regents of the University of Colorado, (303) 492 -2222
Sec. 16, Twp. 1 South, Rng. 70 West, 6th P.M., Boulder County
Office of the State Engineer
1313 Sherman Street, Suite 818 • Denver, CO 80203 • Phone: 303 -866 -3581 • Fax: 303 - 866 -3589
www.water.state.co.us
John W. Hickenlooper
Governor
Mike King
Executive Director
Dick Wolfe, P.E.
Director /State Engineer
COMMENTS: The applicant has requested full reclamation responsibility release for the Deepe Farm Pit.
According to the request, reclamation at the site is complete. There are two small ponds remaining on the site,
approximately 1.73 acres and 2.26 acres in size. An approximately 14.2 -acre lake existed at the site prior to
December 31, 1980. The location of the 1.73 -acre pond is within the area originally covered by the lake. In a
letter dated January 31, 2011, the Division of Water Resources allowed the applicant to move a portion of the
pre -1981 exposure area to include the 2.26 -acre pond. Both ponds are therefore considered to be pre -1981
and, pursuant to § 37- 90- 137(11)(b), the applicant is not required to replace depletions from evaporation of the
ponds. Based on the above, this office has no objection to the request for full reclamation responsibility release
for the Deepe Farm Pit.
RECEIVED
JUL 0 6 2012
Division of Reclamation.
Mining & Safety
