There are two small ponds remaining on the site, <br />approximately 1.73 acres and 2.26 acres in size. An approximately 14.2 -acre lake existed at the site prior to <br />December 31, 1980. The location of the 1.73 -acre pond is within the area originally covered by the lake. In a <br />letter dated January 31, 2011, the Division of Water Resources allowed the applicant to move a portion of the <br />pre -1981 exposure area to include the 2.26 -acre pond. Both ponds are therefore considered to be pre -1981 <br />and, pursuant to § 37- 90- 137(11)(b), the applicant is not required to replace depletions from evaporation of the <br />ponds.
