license prior to conducting any exploration on lands that are both not under lease <br />and lands that are under lease and prior to the Division issuing a permit. The EIS <br />should include a clarifying statement that the Division must issue an exploration <br />license for any coal exploration activities in the state, whether the lands are not <br />leased, the lands are leased and no permit is issued or the lands are leased and a <br />permit is issued. For the sake of simplicity, I think in the last case (lands leased <br />and permit issued) it is not worth confusing the issue to discuss that a minor <br />revision is required rather than an exploration license (as the end result is <br />basically the same). <br />This concludes my review of the Draft Environmental Impact Statement, prepared by the <br />Paonia Ranger District, for Federal Coal Leases COC -1362 and COC -67232 for the West <br />Elk Mine.
