Z : tik NOTICE OF PROPOSED DECISION The Colorado Division of Reclama- tion, Mining and Safety proposes to Approve Technical Revision Application No. 72 (TR -72) for the Bowie No. 2 Mine (Permit No. C- 1996 -083), submitted by Bowie Resources, LLC. J. E. Stover and Associates, on behalf of Bowie Resources, LLC, is proposing to ex- pand Coal Mine Waste Pile #2. The existing hillside slope to the west of the waste pile will be increased to 1.5h:1v slope, the West Diver- sion Ditch #2 will be relocated to the toe of the slope and the waste pile will expand to fill in the void created by the steeper slope. The disturbed area will increase by 1.8 acres for an addition storage ca- pacity of 65,000 cy. All proposed disturbances are within the present permitted boundary and on land owned by Bowie Resources, LLC. The Bowie No. 2 Mine is a /an Un- derground coal mine located in Delta County, approximately 5 miles NE of Paonia, Colorado. Coal interest is Federal and private, and the surface affected is Federal and private land. The permit area en- compasses approximately 8,300.50 acres. This proposed decision is based on a finding that the proposed operation will comply with all re- quirements of the Colorado Sur- face Coal Mining Reclamation Act, Section 34 -33 -101, et seq., C.R.S., and the regulations promulgated thereunder. Copies of the proposed decision, including stipulations, are on file for public inspection at the Colo- rado Division of Reclamation, Min- ing and Safety, Room 215, Centen- nial Building, 1313 Sherman Street, Denver, Colorado 80203. Persons with an interest that may be ad- versely affected by the proposed decision may request a formal hearing before the Mined Land Reclamation Board on the pro- posed decision. Such request must be made within ten (10) days of the initial publication of this notice, must be in writing, and must state with reasonable specificity the rea- sons for the request and the objec- tions to the proposed decision.
