Division Reclamation, Mining, and Safety
1313 Sherman Street Room 215
Denver, Colorado 80203.
United States Department of Interior
Office of Surface Mining
Reclamation and Enforcement.
MB Broadway St. Suite 3320
Denver. Colorado B0202 -3D511
May IT, 7012
Re: The mining Operations in Nude, Colorado
To Wham It May Concern: Thisis a formal complaint.. Due_to a tragedy anda_death in thafemily..we have all been brought
back to Nucla. This is the place I lived all my life and grew up. The property in which I lived has now been mined and
reclaimed West of 27 Road. None of this looks the same. There is now a 30 foot Mountain that was never there. This Is
very much an eye sore. It should have been returned like it was.
l have been taking pictures of the current operation and going_over facts. This is not being_done correctly. The earth
should be returned like it was. Why is this black spoil being brought to the top? It does not belong there. Why is there
really nice red dirt being pushed off into the bottom of the pit? I took pictures of all of this.
The Regulations are extensive and hundreds of pages. The rules that I know are the soils are to he returned like they
were. However they were naturally. Put it back as goad as it was.
When has topsoil been allowed to be removed in a one lift operation' This has been happening since [was here last time.
All soils must be segregated and all mines must do farm ground in a two -lift operation. What Regulation allows for them
to do this?
Also, going over some of this documentation. prior permits have not been in full compliance. San Miguel Power Property
did not even have a Right of Entry. How does the State control a piece of property that never had a Right of Entry to even
be mined? This is all a formal complaint and I would like an answer to.
Also. how is an operator allowed to remove prime farmland soils from a farm and give it to another farm?
I think that.there.are many vinlations_here.and I know whatall of this looked like_when l.grew. up. I wished I had gotten
involved Ion efo e now, but some of these things are on ground violations that are happening right now.
9CJ !
Pc r
iL at`tit o$s n
4h,7,T 74p4-1
1°11.... 3 J2(
