BEFORE THE MINED LAND RECLAMATION BOARD <br />STATE OF COLORADO <br />FINDINGS OF FACT, CONCLUSIONS OF LAW, AND ORDER <br />IN THE MATTER OF COTTER CORPORATION'S REQUEST FOR A DEADLINE <br />EXTENSION, File No. M- 1984 -014 <br />THIS MATTER came before the Mined Land Reclamation Board ( "Board ") on <br />June 13, 2012 in Denver, Colorado as a consent agenda item to consider a request <br />by Cotter Corporation ( "Operator ") to extend the decision deadline beyond the 365 <br />day review period for its Environmental Protection Plan, file number M- 1984 -014. <br />The Board, having considered the materials presented with this consent <br />agenda item and having been otherwise fully informed of the facts in the matter, <br />hereby enters the following: <br />FINDINGS OF FACT <br />1. The Operator holds a permit for an underground uranium mining <br />operation located in Section 26, Township 46 North, Range 17 West, 10th Principal <br />Meridian. The operation, known as the JD -8 Mine, is located in Montrose County, <br />Colorado, permit number M- 1984 -014. <br />2. On June 8, 2011 the Operator submitted an Environmental Protection <br />Plan ( "EPP ") for the JD -8 Mine. <br />3. The Division has received an objection to the EPP. <br />4. At this time, there remain outstanding review issues that must be <br />addressed and will not be completed by the 365 -day limit set forth in Rule 1.4.1(9). <br />5. The Division and Operator agree that an additional sixty (60) days will <br />allow completion of the review so a decision can be issued on the EPP submittal and <br />provide sufficient time for the public participation process related to the objection. <br />6. A hearing will be scheduled for the August 8 -9, 2012 Board meeting. <br />7. The objecting party has been notified of the extension request and <br />verbally indicated that it has "no issue" with it. <br />8. The Division recommends the Board approve the extension of the <br />review period to July 15, 2012 to allow completion of the review of the EPP and <br />scheduling of the required Board hearing for August 8 -9, 2012. <br />
