Preliminary Adequacy Review

Dear Mr. Thompson:

The Division has completed a preliminary review of the TR-66 application and has the following comments.

1. Please provide a description on how the proposed Haul Road to the RDA will be used in support of
the post mining land use, as defined in Section 1.04(71), per Rule 4.03.1(f)(i). The Division feels that
in order for the proposed Haul Road to remain post mining, it must provide practical use in
conjunction with its post mining land use.

Please provide a letter from the legal or equitable landowner that would request the

proposed Haul Road to remain left open for further use post mining as required by Rule
4.03.1(f)(ii).

It is unclear on whether the proposed Haul Road design width is appropriate for the overall

size of vehicles and volume of traffic. The typical Remote and RDA Haul Road cross
section found on Map 1-Sheet 1 shows the Haul Road having a 10 foot minimum width.
Please provide a description on how this width will be suitable for the anticipated traffic or
if additional construction of the Haul Road will be needed to attain appropriate width as per
Rule 4.03.1(3)(c).

4. The final two paragraphs on Page 2.05-10 discussing the SAE south of Pond 7 and the cut slopes
above the upper divisions ditch at the Bates Portal have been removed. Please provide an explanation
on why these discussions were removed from Page 2.05-10 or submit a revised page including these
paragraphs.

5.There appears to be an an error on Map 13 – East Portal Sediment and Surface Water
Control Plan. There is an additional culvert “C-A” near the bottom of the haul road to the
RDA. Please submit a revised Map 13 correcting this error.
