SGC is a corporation duly organized and exiting under the laws of the State of Delaware <br /> 3 and having its principal place of business in San Juan County, Colorado. ...A wholly owned subsidiary of Echo <br /> 4 Bay Mining Corporation... <br /> 5 b. SGC owns inactive mining properties in San Juan County, Colorado, near the City of <br /> 6 Silverton. One of these is the Sunnyside Mine (the "Mine"). SGC operated the Mine for approximately six <br /> 7 years, from 1985 to 1991, although the Mine has operated under other owners for many decades. <br /> 8 C. The Colorado Water Quality Control Division is an agency of the state of Colorado duly <br /> 9 created....and administers the CDPS program... <br /> 10 <br /> d. Part 5 of the Act, among other things, requires a Colorado discharge permit for the <br /> 11 discharge of pollutants from a point source into state waters. A discharge permit is required prior to the <br /> 12 occurrence of a discharge of pollutants from a point source. <br /> 13 e. SGC has existing CDPS permits in San Juan County as follows: <br /> 14 1) CO-0027529 -American Tunnel: authorizes the discharge of mine water from the <br /> 15 Sunnyside Mine(and other waters entering the tunnel) through the American Tunnel to Cement Creek in <br /> 16 accordance with numeric effluent limits. <br /> 17 2) CO-0036056 - Terry Tunnel: authorizes the discharge of mine water from the <br /> 18 Sunnyside Mine through the Terry Tunnel to Eureka Creek in accordance with numeric effluent limits. <br /> 19 3) CO-0000426 -Mayflower Mill: authorizes the discharge of mine water from the <br /> 20 Mayflower Mill tailings piles to the Animas River(?) in accordance with numeric effluent limits. <br /> 21 4) COR-040052 - American Tunnel Stormwater: authorizes the discharge composed <br /> 22 entirely of stormwater from the site to Cement Creek in accordance with the site Stormwater Managment Plan <br /> 23 ("SWMP"). <br /> 24 5) COR-040053 -Ross Basin-Brenneman Vein Project Stormwater: authorizes the <br /> 25 discharge composed entirely of stormwater from the site to the North Fork of Cement Creek in accordance with <br /> the site SWMP. <br /> 26 <br /> 27 6) COR-040054 -Mayflower Mill Stormwater: authorizes the discharge composed <br /> 28 entirely of stormwater from the site to the Animas River in accordance with the site SWMP. <br />
