Regulations for Effluent Limitations: The Regulations for Effluent Limitations (10.1.0), apply to the <br />conventional pollutants. For this facility the limitation for oil and grease is based on this regulation. <br />b. Applicable Federal Effluent Guidelines and Standards: Since no active mining is occurring, no federal <br />guidelines apply to this type of facility. <br />c. Flow Limitation: The permittee has entered into a consent agreement with the State, which specifies how the <br />combination ofAmerican Tunnel flow and the flows Cement Creek and its tributaries will be routed through <br />the treatment plant. The flow routing procedure may be relatively complicated and specification of a single <br />flow limit may not be possible. Therefore, only flow reporting, without a limit, will be required. <br />d. Limits Based Upon Best Professional Judgment: The previous permit contained effluent limits for TSS and <br />metals that were based upon the federal effluent regulations (BAT). And, the pH limit was based upon a BPJ <br />adjustment to the State Effluent Regulation limit, which resulted from the Division's consideration of impacts <br />to the receiving stream. <br />No active mining is currently occurring. Therefore federal BAT limitations are not directly applicable. <br />However, as a result of the consent agreement between the permittee and the state, the permittee will operate <br />the treatment plant in the same manner as that which was done during the term of the previous permit, and <br />effluent concentrations will likely be similar to those discharged in the past. Therefore, the same limits for <br />TSS, metals and pH contained in the previous permit will be implemented in this renewal permit. <br />
