I. JURISDICTION <br /> 1. This Court has jurisdiction over the Parties and the subject matter of this action and <br /> decree. <br /> II. PARTIES BOUND AND FINDING <br /> 2. Upon entry, this Consent Decree will apply to and be binding upon each of the <br /> Parties, and upon any successors in interest and assigns. The undersigned representatives of <br /> the respective Parties certify that they are fully authorized by the Party whom they represent to <br /> enter into the terms and conditions of this Consent Decree, to execute this Consent Decree, <br /> and to legally bind that Party to the terms and conditions of this Consent Decree. <br /> 3. The Parties agree, and the Court finds, that the settlement embodied in this <br /> Consent Decree is lawful under the Act, is consistent with the purposes of the Act, and is <br /> intended to protect the waters of the State of Colorado. <br /> III. DEFINITIONS <br /> 4. Words used in this Consent Decree that are defined in the Colorado Water <br /> Quality Control Act, C.R.S. § 25-8-101 ("Act") or regulations promulgated pursuant to the <br /> Act ("regulations") are defined, for purposes of this Consent Decree, as defined in the Act and <br /> regulations. Other words used in this Consent Decree are to be taken and understood in their <br /> ordinary sense unless this Consent Decree indicates that a different meaning was intended. <br /> ��-�. 8 <br />
