Renewal SGC will continue to operate the American <br /> Tunnel water treatment facilities until they are no longer necessary to maintain the dissolved <br /> zinc criterion at the Reference Point. Diversion of Cement Creek waters, which are different <br /> in character from mine water, may bring altered conditions into the American Tunnel water <br /> treatment system. Since the fourth quarter of 1993, SGC has passed all chronic Whole <br /> Effluent Toxicity (WET) tests at the Instream Waste Concentration (IWC) ratio, which <br /> demonstrates that the treated mine water discharge has not been toxic. SGC's renewal <br /> American Tunnel permit will not include WET testing. The Division determined that if <br /> current treatment levels are maintained and Cement Creek flows are treated, downstream <br /> aquatic life uses will be protected. Effluent limitations in the American Tunnel discharge <br /> permit will continue to be based on BAT standards until the permit is terminated. <br /> C. Qther Permits. All activities undertaken by SGC pursuant to this <br /> Consent Decree will be undertaken in accordance with the requirements of all applicable local, <br /> state and federal statutes, regulations, and ordinances. SGC will make timely application for <br /> any necessary permits or certifications.
